Step by Step Guide to Apply for a Liquor License Gauteng.

FIRST SEE TO IT THAT THE ZONING OF THE PREMISES IS CORRECT FOR THE TYPE OF LICENSE INTEND TO APPLY FOR, TO BE ABLE TO OBTAIN YOUR LAA CERTIFICATE FROM THE MUNICIPALITY – CITY PLANNING DIVISION as mentioned below:

LAA – Local Authority Approval – An original printed approval on the relevant letterhead signed by the designated executing officer and not a ward councilor.

Submission of an LAA is for ALL: TAVERNS, POOL CLUBS, PUBS, LIQUOR STORES, & NIGHT CLUBS according to: Section 23(4) of the Liquor Act.

You can apply for the LAA at city planning division, at the municipal office of the region under which the business premises falls. You will require a copy of ID of client, Company Document, Lease Agreement, Zoning Certificate and a Copy of the Building Plan of the premises. Please note any or all documents submitted must not be older than 3 months.

Documents Required for Liquor License Application:

  1. COMPLETED FORM1 APPLICATION FORM (DOWNLOAD SAMPLE)

  3. APPLICATION FEES – Proof of payment of the prescribed fees – Payable at FNB in cash with reference number of form – Section 23(1)(i) (After you submitted Form 1 you will get a reference number. This is the number used to do the payment at FNB)
  4. MOTIVATION / REPRESENTATION – A detailed written motivation in support of the license applied for – Sec. 23(1)(a)
  5. DESCRIPTION – A detailed written description of the premises – Section 23(1)(c)
  6. LAA – AS ABOVE EXPLAINED – Local Authority Approval, HEALTH & EMERGENCY SERVICES CERTIFICATES from the Local Municipality
  7. ZONING DOCUMENTS OF THE PROPOSED PREMISES – Obtain from the Municipal Offices.
  8. COI & RESOLUTION – Cert. of Incorporation & Original resolution – To verify signing powers & members / Shareholders if applicable.
  9. CLEARANCE CERTIFICATE issued by S.A.P.S of Applicant or members of CC/shareholders of company – Section 36 (Fingerprints at SAPS)
  10. CLEARANCE CERTIFICATE from S.A.R.S. (for TENDER) on name of APPLICANT & correct TRADING / BUSINESS NAME – Section 23(1)(j)
  11. ID – Certified copy of identity document/s – To verify information as given on Form 1
  12. LIQUOR ASSOCIATION – Proof of membership of a liquor association, affiliated with GLTA – (Section 23(1)(h) & 38
  13. TOBACCO AFFIDAVIT – Compliance with Tobacco Products Control Amended Act No 12 of 1999 – (affidavit to comply with legislation and demarcation of smoke area on plan) – Section 23 (4)
  14. 500m RADIUS AFFIDAVIT – Section 30(3) & 49 Declare premises not within 500m radius of any schools, churches, other liquor outlets, and public places. If any within 500 meter radius, declare it as well.
  15. MENU – food (for on consumption liquor use) serving of food controlled according to the Act definitions.
  16. PLO – Proof of Lawful Occupation – of the premises (Lease Agreement / Title Deed & CONSENT USE if applicable.
  17. NOTICES – Proof of publications (Government Gazette & 2 Local Newspapers) supply whole ORIGINAL pages – Section 23 (1) – PUBLIC NOTICES
  18. PLAN – A detailed APPROVED plan of the premises (Proof of compliance with Bylaws) and smoke section marked if applicable – Section 23(1)(b) Minimum public space: (Off-Consumption – 50m2, On-Consumption – 30m2.
  19. COLOR PHOTOS of the external & internal features of the premises – Section 23(1)(c).
  20. Application Certificate of Acceptability.
  21. RP1 Application for Issue of Business License.
